Terms of Service

1. Acceptance of these Terms
These Terms of Service (“Terms”) are a binding agreement between you and PickUps (“PickUps,” “we,” “us”). By creating an account or using dashpickups.com and related services (the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility — you must be 18+
You must be at least 18 years old to create an account. By registering, you represent and warrant that you are 18 or older and that all information you provide is accurate. You are responsible for everything that happens under your account.
3. Player profiles and authorization
The Service lets you create and manage one or more player profiles. By adding a player profile, you represent that you are the player or are otherwise legally authorized to create and manage that profile and to provide the information in it. You are responsible for the accuracy of each profile and for keeping it up to date.
4. What the Service is — and is not
PickUps is a venue that helps teams and players find each other for tournaments and games. PickUps is not a party to any arrangement you make with another user, does not employ players or coaches, does not organize teams or events, and does not supervise, direct, or control any game, practice, tryout, travel, or other activity. Any agreement to play, host, pay, or travel is solely between the users involved.
5. Verification is a tool, not a guarantee
We may offer identity, age-eligibility, or other verification features. These are conveniences and signals only. We do notguarantee any user’s identity, age, eligibility, background, character, or conduct. You are solely responsible for independently evaluating, and deciding whether to interact with, any other user, team, or player.
6. Conduct and safety
You agree to use the Service lawfully and respectfully. You will not harass, threaten, deceive, or endanger anyone; impersonate others; misrepresent a profile; or use the Service for any unlawful purpose. Sharing personal contact information through messages may be filtered or removed. Report any safety concern immediately using the in-app report tools; if someone is in danger, contact local authorities first.
7. In-person activities — assumption of risk and release
Games, practices, tryouts, pickups, travel, and any other in-person activities arranged through the Service carry inherent risks, including risk of injury. You participate at your own risk. To the fullest extent permitted by law, you assume all risks arising from in-person activities and from interactions with other users, and you release PickUps and its owners, employees, and agents from any claims, demands, or damages arising out of those activities or interactions. A separate participation waiver may be required by a team, organizer, or sanctioning body — that is between you and them.
8. Your content
You retain ownership of the content you submit (profiles, highlights, photos, messages). You grant PickUps a worldwide, non-exclusive, royalty-free license to host and display that content as needed to operate the Service. You are responsible for your content and represent that you have the rights to share it and that it is not unlawful, infringing, or inappropriate.
9. Fees
The Service is currently free to use. We may introduce paid features in the future; if we do, the applicable pricing and terms will be presented before you are charged.
10. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any match, player, or team will meet your expectations.
11. Limitation of liability
To the fullest extent permitted by law, PickUps and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any conduct of any user or third party. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the prior twelve months or one hundred U.S. dollars ($100).
12. Indemnification
You agree to indemnify and hold harmless PickUps and its owners from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your interactions with other users, or your breach of these Terms.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or its users.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the effective date above, and your continued use of the Service after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.
